WAVIER OF LIABILITY AND INDEMNIFICATION


The Applicant shall use reasonable care and make reasonable diligent efforts to avoid any harm, injury, or loss of property to any person while using these premises during the term of this rental. Applicant agrees to indemnify and hold harmless the Belle Creek Family Center and the Belle Creek Metropolitan District No. 1 (Released Parties) from any liability, sums and costs, including attorney fees and all other fees incidental and defend any loss or damages the Released Parties may suffer as a result of claims, demands, costs, or judgments resulting from Applicant’s use of the facility.

Applicant, its successors, and assignees assume all liability and risk associated with the use of Belle Creek Family Center and hereby releases and agrees to indemnify, defend and hold harmless, the Released Parties, and their representatives, staff, employees, agents, and directors from any and all claims, liability , injuries, damages, and costs incurred by Applicant, any of Applicant’s guests, or other persons in connection with Applicant’s use of any property owned or managed by Belle Creek Family Center. Applicant further acknowledges that they have reviewed and evaluated the risks and determined to use the Belle Creek Family Center with full knowledge and acceptance of the risks.

Applicant understands that the Released Parties do not provide insurance coverage for accidents or injuries sustained by Applicant, guests, or other persons. Applicant agrees that use of the Belle Creek Family Center and participants in activities or events at the Belle Creek Family Center shall be undertaken by Applicant and guests at their sole risk, and the Released Parties shall not be liable for any injuries or damage to Applicant, guests, or other persons, or subject ot any claim, demand, injury, or damages whatsoever, irrespective of cause or origin,. The Released Parties, shall not be responsible or liable for articles damaged, lost, stolen, or for loss or damages to any property. The undersigned evidences by their signature what the Applicant and its group or organization has read and will comply with the rules and regulations as stated on the form provided to the Applicant.


INSURANCE REQUIREMENTS FOR BUSINESS ENTITIES AND VENDORS

Applicants shall, at its own expense, obtain and maintain during the term of this agreement, General Liability Insurance with a limit of $1,000,000 per occurrence and $2,000,000 general aggregate limit. Applicant will provide certificate of insurance including Belle Creek Metropolitan District No. 1 as Additional Insureds.



BELLE CREEK FAMILY CENTER RENTAL GUIDELINES


- Belle Creek Family Center sponsored programs and activities have priority use in the Family Center. Therefore certain dates may not be available for use.

- Reservations will not be considered final until approval is granted, contract signed, and the appropriate down payment has been received. Rentals are approved on a first come first served basis with receipt of deposit. All payments will be made by credit card unless otherwise agreed upon by Belle Creek Family center in advance. 

 - The Rental Applicant must be at least 18 Years of age to make a rental reservation and 21 if alcohol is to be present. A copy of the applicant's driver's license is required to reserve a location. 

-Any vendors (DJs, band, table/chair rental company, pipe and drape setup, catering companies, etc.) who will be on site will need to provide the Family Center proof of insurance listing the “Belle Creek Metro District” as additionally insured. 

- Non-Refundable deposit of 50% must be paid when reserving any space. 

-Remainder of balance plus damage deposit must be paid (7) days before the date of the event. 

-Events in excess of 25 guests are subject to a $20 fee per hour for every 25 guests during normal business hours to provide additional staffing

- Facility rental outside of normal hours of operation requires an additional $30 per hour for residents and $40 for non residents for every 25 guests. 

- All facility users will furnish their own equipment, tables, chairs, and materials unless specifically designated on the Rental Application or confirmed by the Event Manager or Family Center Manager.

- The Belle Creek Metropolitan District #1 will not be responsible for any lost, stolen, or damaged items.

- All decorations or equipment must be taken down immediately following the rental and leave no visible marks or damage 

-Helium Balloons are prohibited inside the Belle Creek Family Center, Balloon arches, non helium Balloons are permitted with approval

-The areas agreed upon and listed in the rental agreement are the only areas that will be utilized by the group. All other areas are off limits.

- All set up, maintenance, and tear down is the responsibility of the applicants group or organization, unless the applicant has paid for set up and tear down service. This service must be purchased in advance and will not be offered on the day of the event. Please ask the Building Attendant at the desk for supplies to clean the area after the event. Any items, trash, spills, or mess left behind will be cause for forfeiture of the damage deposit. 

- For full use of the Kitchen it will be a separate rental agreement and additional charge will be assessed. Reasonable storage for food, drink will be included with no additional rental.

- All set up and tear down must be included in the rental time. If the event ends early the applicant will still be billed for the time agreed upon. If the event continues past the agreed upon end time then the applicant will be billed at a rate of 2 times the rental cost if not arranged in advance. 

- Adult supervision of children is required at all times and in all areas. 

- Event parking is limited to the South Parking Lot. Anyone parking on the street may be subject to tow or ticket based on city ordinance. 

- Any and all litter/trash generated by the event or attendees of the event must be collected from the interior and exterior of the building by the applicant and their event organizers and disposed of properly.

- Events can go no later than 11:00pm. Music should never be heard beyond the street and should not be heard at all outside of the Family Center after 10pm. 

- Rental party must complete the room checklist prior to having the room checked by the Family Center employee. 

- A Damage Deposit is required for all rentals and will be refunded once the Site Coordinator has signed off on the event clean up. This refund could take 7-10 business days to be processed. 

- Violation of any city ordinances including but not limited to: parking, open container, noise, disorderly conduct, loitering, etc.. constitutes a forfeit of the deposit.


Rental Contract


This document assures that the below signed agrees to indemnify and hold harmless the Belle Creek Metropolitan District #1, Belle Creek Family Center, their staff, volunteers, and insurers, against all liability, claims and demands, on account of injury, loss or damage, including without limitation claims arising from bodily injury, personal injury, sickness, disease, death, property loss or damage, or any other loss of any kind whatsoever, which arises out of or is in any manner connected with the use of any property owned or managed by Belle Creek Metropolitan District #1, if such injury, loss or damage is caused in whole or in part by, or is claimed to be caused in whole or in part by, the act, omission, negligence, or other fault on the part of any representative of the Belle Creek Metropolitan District #1. 

The below signed understands that using any property owned or managed by Belle Creek Metropolitan District #1 may involve risks of injury, loss or damage to property, including but not limited to bodily injury, personal injury, sickness, disease, death, and property loss or damage. By signing this agreement the below signed expressly agrees to assume any and all such risks. In addition, in consideration for being permitted to the the property, the below signed herby expressly exempts liability, claims and demands, on account of injury, loss or damage to property, which they under signed may incur as a result of being on the premises of any property owned or managed by Belle Creek Metropolitan District #1, whether any such liability , claim or demand is claimed to be caused by negligence or other fault on the part of Belle Creek Metropolitan District #1, its staff, volunteers, or from any other cause whatsoever.
